US Export Controls

U.S. export controls include those imposed on dual-use goods under the Export Administration Regulations (EAR) by the Commerce Department's Bureau of Industry and Security (BIS), as well as controls on exports of defense articles and services by the State Department's Directorate of Defense Trade Controls (DDTC) under the International and Traffic in Arms Regulations (ITAR). The control lists administered by these agencies are the Commerce Control List (CCL) and the U.S. Munitions List (USML), respectively.

Clear Terms

Search Primer

Term list: Separate terms with spaces, not commas or semicolons.

Multi-word term: Place inside quotes to ensure an exact match (e.g. "China import").

Acronyms: Use all capital letters to ensure the search is not looking for that letter sequence instead.

Required term: If a term must be included in any resulting articles, prefix it with a plus sign (e.g., +CBP).

Excluded term: If a term should be excluded from any articles being found, prefix it with a minus sign (e.g., -ruling).

Singular form: Always use the singular form when doing multi-word terms (e.g. "russian export control" instead of "russian export controls").

Trade Court Says CBP Failed to Adequately Explain Forced Labor Finding on Extrusions Exporter

CBP failed to explain its finding that Dominican exporter Kingtom Aluminio made its aluminum extrusions with forced labor, the Court of International Trade held on Sept. 23. Vacating and remanding the forced labor finding, Judge Timothy Reif said the agency failed to "articulate a satisfactory explanation for its action” based on a “rational connection between the facts found and the choice made" in violation of the Administrative Procedure Act's arbitrary and capricious standard.

US Relied on Inaccurate Information From Competitor for Entity Listing, YMTC Says

Chinese semiconductor company Yangtze Memory Technologies Corp. accused the Bureau of Industry and Security of illegally withholding documents related to its placement on the Entity List, adding that the government acted on "inaccurate" information from YMTC competitors when it imposed stringent export license requirements on the company in 2022. The firm also questioned whether the End-User Review Committee, the interagency group that makes decisions on adding or removing companies from the Entity List, followed proper protocol when it voted to put YMTC on the list.
