US Export Controls

U.S. export controls include those imposed on dual-use goods under the Export Administration Regulations (EAR) by the Commerce Department's Bureau of Industry and Security (BIS), as well as controls on exports of defense articles and services by the State Department's Directorate of Defense Trade Controls (DDTC) under the International and Traffic in Arms Regulations (ITAR). The control lists administered by these agencies are the Commerce Control List (CCL) and the U.S. Munitions List (USML), respectively.

Clear Terms

Search Primer

Term list: Separate terms with spaces, not commas or semicolons.

Multi-word term: Place inside quotes to ensure an exact match (e.g. "China import").

Acronyms: Use all capital letters to ensure the search is not looking for that letter sequence instead.

Required term: If a term must be included in any resulting articles, prefix it with a plus sign (e.g., +CBP).

Excluded term: If a term should be excluded from any articles being found, prefix it with a minus sign (e.g., -ruling).

Singular form: Always use the singular form when doing multi-word terms (e.g. "russian export control" instead of "russian export controls").

Shortest word form: When you have different word forms in a quoted (multi-word) term, you want to only include the shortest version if it is the last part of the expression (e.g., "entity list" instead of "entity listing" or "entity listed").

EU General Court Annuls Sanctions Listing of Russian Businessperson

The EU General Court on May 29 annulled the European Council's sanctions designation of Russian businessperson Farkhad Akhmedov, founder of Russian gas equipment supplier Tansley Trading and minority shareholder of Northgas. The court said that the council "made an error of assessment" in sanctioning Akhmedov "by considering that the applicant was a leading businessperson involved in economic sectors which provided a substantial source of revenue to" the Russian government.

CIT Bucks Use of AFA on Brazilian Honey Exporter

The Court of International Trade on May 30 rejected the Commerce Department's use of adverse facts available against Apiario Diamante Comercial Exportadora and Apiario Diamante Producao e Comercial de Mel, collectively doing business as Supermel, in the antidumping duty investigation on raw honey from Brazil. The decision sends back the 83.72% AD rate levied against the exporter.

Export Control Prosecutor Leaves DOJ for Law Firm

David Lim, a former prosecutor with DOJ’s Counterintelligence and Export Control Section, has joined White & Case as partner, the firm announced May 29. Lim, who left DOJ earlier this month, was the co-director of DOJ’s Task Force KleptoCapture, where he supervised investigations and prosecutions of Russia-related sanctions and export control violations. The firm said he will advise clients on export control and sanctions enforcement risks and help handle government and internal investigations.
