Differential Pricing Analysis

The Commerce Department uses a differential pricing analysis to detect whether companies are selling goods across different time periods, regions or purchasers in an effort to mask the dumping of their products into the U.S. market. As part of this analysis, the agency will use a statistical test, called the Cohen's d test, to see if the prices of the exporter's U.S. sales vary significantly across region, time period or purchaser. Use of this test as part of the differential pricing analysis has been subject to much litigation, with the primary point of contention being whether Commerce must satisfy basic statistical assumptions such as roughly equal variances and normally-distributed data sets when running the test.

The Obama administration should continue to impose “narrow” sanctions on individuals and firms in Russian financial, energy and defense sectors, said Senate Foreign Relations Committee Chairman Bob Menendez, D-N.J., in opening remarks at a May 6 hearing on the ongoing crisis in Ukraine. BIS Toughens Restrictions on Exports to Russia

The Commerce Department’s Bureau of Industry and Security on April 28 expanded export restrictions for high-technology dual-use items subject to the Export Administration Regulations and destined for Russia, in response to ongoing crisis in eastern and southern Ukraine. President Barack Obama said on April 28 the U.S. shouldn’t allow for possible military exports to the country “in this kind of climate.” The Russian government did not honor its commitment to de-escalate the ongoing crisis in Ukraine, said the White House in a press release.

OFAC Penalizes CWT B.V. for Travel Services Violations of Cuba Sanctions

The Treasury Department’s Office of Foreign Assets Control (OFAC) settled a potential civil liability case with CWT B.V. for alleged violations of the Cuban Assets Control Regulations. OFAC penalized the company $5,990,490 for travel services infractions that took place from 2006 to 2012. The infractions also violated the Trading With the Enemy Act, according to OFAC.
