The U.S. removed sanctions from two former board members of a Russian state-owned bank after both argued they didn’t meet the criteria for placement on the Treasury Department’s Specially Designated Nationals List. The sanctions removals, made by the Office of Foreign Assets Control late last month, came after Russian nationals Elena Titova and Andrey Golikov, in separate complaints, sued the U.S. government over their designations, accusing it of sanctioning them on “no factual basis” and “unnecessarily” delaying delisting decisions.

A former board member of a Russian state-owned bank asked a federal court to order the U.S. to remove her from a U.S. sanctions list, saying there is “no factual basis” that supports her listing. In a complaint recently filed with the U.S. District Court for the District of Columbia, Elena Titova, a dual Russian and U.K. citizen, said she resigned from her position eight days after Russia’s invasion of Ukraine last year but was still added to the Treasury Department’s Specially Designated Nationals List even though she hasn’t been designated by any “other nation in the world.”

The Treasury Department wants to modernize its licensing approach to more easily allow humanitarian groups to send aid to sanctioned jurisdictions, said Alex Parets, counselor to Treasury’s undersecretary for terrorism and financial intelligence. Parets, speaking during a Nov. 14 event hosted by the Center for Strategic and International Studies, said the administration is prioritizing work to improve its exemption process for humanitarian organizations and banks working with them.

The Treasury Department needs to provide significant assurances to banks and non-governmental organizations that they will not be sanctioned for transactions related to humanitarian relief in Afghanistan (see 2108260055), a former sanctions official and an export control official said. Without those assurances, large banks will be unwilling to risk approving transactions to the country because they fear violating U.S. sanctions and potentially large enforcement penalties.

Two Iranian businessmen sanctioned by the U.S. said they were illegally targeted by the Office of Foreign Assets Control and asked the U.S. District Court for the Central District of California to vacate their designations. Behzad Ferdows and Mehrzad Ferdows, residents of Germany and Iran, said in a Nov. 5 lawsuit that OFAC violated “constitutional norms,” statutory requirements and failed to follow due process when the agency sanctioned both men in September.

An aircraft holding company is suing the Treasury Department after the agency blocked a transaction involving the company and an alleged Specially Designated Global Terrorist, according to court records filed June 2. In the lawsuit, Seychelles-registered Askan Holdings, owned by Romania-based Transylvania International Airlines SRL, argued that no sanctioned party was involved in the transaction and said the Treasury’s Office of Foreign Assets Control failed to identify the blocked party or grant Askan a license. Askan is asking a court to order OFAC to grant the license or to stop blocking the transaction.

Oleg Deripaska, a Russian businessman who was sanctioned by the U.S. in 2018, sued the Treasury Department last week, alleging its sanctions rely on “unsubstantiated” allegations and have led to the “utter devastation” of his “wealth, reputation, and economic livelihood,” according to court documents. The suit, filed March 15, requests that the U.S. District Court for the District of Columbia order Treasury's Office of Foreign Assets Control to remove the sanctions. It names Treasury Secretary Steven Mnuchin, Treasury Department OFAC Director Andrea Gacki, the Treasury Department and OFAC as defendants.
