N351665: The eligibility of lancets under the Nairobi Protocol from China

Nairobi Eligibility: Yes
Item: iHealth Disposable Lancets (blood sampling needles) consist of metal-needle like articles having tri-bevel tips encased in plastic holders with twist-off protective caps. They are to be solely used by people with diabetes to penetrate the outer layer of the skin on the finger or alternate site in order to obtain a small capillary blood sample for blood glucose testing. These lancets are single-use only and must be used in conjunction with a compatible lancing device and blood glucose monitoring system.
Reason: The lancets are used to obtain a diabetic’s blood sample to be analyzed by a blood glucose monitoring device. It is a crucial tool for individuals with diabetes, enabling them to monitor their blood sugar levels regularly.

N350938: The country of origin of INFLECTRA® for Injection

Origin: Korea
Item: INFLECTRA (Infliximab-dyyb) for Injection, imported in 100 mg vials, is a biologic treatment called a biosimilar that contains the active ingredient, Infliximab-dyyb. Inflectra is a tumor necrosis factor (TNF) blocker that is administered via intravenous (IV) infusion for the treatment of Crohn’s Disease; Pediatric Crohn’s Disease; Ulcerative Colitis; Pediatric Ulcerative Colitis; Rheumatoid Arthritis; Ankylosing Spondylitis; Psoriatic Arthritis; and Plaque Psoriasis. The API or DS, is manufactured in South Korea and the finished vials in dosage form are made in Portugal. In Portugal, the API (Infliximab-dyyb) will be formulated and combined with excipients, filled into vials and lyophilized into powder form to produce the final dosage drug called “unlabeled drug product (uDP)” in 100 mg vials.
Reason: The processing of the active ingredient (made in South Korea) with excipients into 100 mg vials in dosage form in Portugal does not result in a substantial transformation and the country of origin will be South Korea.

N350941: The tariff classification of a plastic automotive body trim piece from South Korea

HTS: 3926.30.5000, 9903.01.25, 5.3% + 10%, “[o]ther articles of plastics and articles of other materials of headings 3901 to 3914: [f]ittings for furniture, coachwork or the like: [o]ther.”
Item: The product under consideration is described as the “ARMREST ASSY-FR DR, LH (VA GRADE),” which is a plastic armrest assembly component installed on the front door trim of the driver’s side of an automobile. This product does not involve any mechanical or electronic functions and is a simple structure attached to the door trim.

Item: The article under consideration is described as a hexalobular socket bolt. This socket head screw is made of steel with a zinc-nickel coating. It measures 5 mm in diameter and 15 mm in length.

N351122: The country of origin of Outdoor Pedestrian Boundary Line LED work lamps

Origin: Thailand
Item: The items concerned are referred to as Outdoor Pedestrian Boundary Line LED work lamps which are rectangular LED work lamps designed for use outdoors to establish a safety zone around the perimeter of a vehicle or heavy equipment with a solid, colored beam of light. The singular printed circuit board assembly (PCBA) which contains all of the functional electrical components (LEDs, capacitors, resistors, diodes, etc.) and which provides the illumination is manufactured in Thailand using surface mount technology. The PCBA is then shipped to China where the final assembly occurs.
Reason: The manufacturing processes that take place within Thailand to create the main PCBA is both substantial and complex. The character of this product is imparted by the PCBA which would be considered the dominant component of this assembly. The assembly/manufacturing process that takes place in China does not change the end use of the PCBA.

N351242: The tariff classification of a digital electronic scale from China

HTS: 8423.10.0010, 9903.01.24; 9903.01.25, free + 20% + 10%, “Weighing machinery (excluding balances of a sensitivity of 5 cg or better), including weight-operated counting or checking machines; weighing machine weights of all kinds; parts of weighing machinery: Personal weighing machines, including baby scales; household scales: Digital electronic type.”
Item: The item under consideration is described as the Cadence Remote Monitoring Scale, which is a digital bathroom scale with cellular connectivity, enabling automatic and seamless transmission of user weight data directly to the Cadence team. The device is also designed to provide weight measurements directly to the user on a large LCD screen. The scale features various components which aid in the usability of individuals with diabetes, chronic heart failure, hypertension, and liver cirrhosis.
Reason: Although the Cadence Remote Monitoring Scale is not marketed or sold through traditional retail channels, this does not change the fact that there are many substantially similar scales on the market that are not specifically designated for use with people with diabetes.

Item: The “Lovebird Home Décor Coat Rack,” is a metal frame coat rack constructed of 100% recycled aluminum. The three-dimensional piece depicts birds and tree branch posts affixed to a center column. The functional coat rack allows for the placement of coats, hats, gloves, scarves, umbrellas, and other objects.

N351545: The tariff classification of Dibasic Ester from China

HTS: 3824.99.9397, 9903.01.24; 9903.01.32; 9903.88.03, 5% + 20% + 25%, “Prepared binders for foundry molds or cores; chemical products and preparations of the chemical or allied industries (including those consisting of mixtures of natural products), not elsewhere specified or included: Other: Other: Other: Other: Other: Other: Other.”
Item: The merchandise in question is called Dibasic Ester. It is said to consist of Dimethyl Glutarate, Dimethyl Adipate, and Dimethyl Succinate. Dibasic Ester will be primarily used in the coatings industry.

N350917: The tariff classification and applicability of subheading 9802.00.6000 of gold jewelry

HTS: 7113.19.5090, 9903.01.25, 5.5% + 10%, “Articles of jewelry and parts thereof, of precious metal or of metal clad with precious metal: Of other precious metal, whether or not plated or clad with precious metal: Other: Other.” (necklace) 7113.19.2900, 9903.01.25, 5.5% + 10%, “Articles of jewelry and parts thereof, of precious metal or of metal clad with precious metal: Of precious metal, whether or not plated or clad with precious metal: Of other precious metal, whether or not plated or clad with precious metal: Other: Necklaces and neck chains, of gold: Other.”
Item: The manufacturing steps are as follows: United States 24 karat gold will be sourced and mixed with silver to achieve the desired karat. United Arab Emirates (UAE) 1. Design is hand drawn. 2. Drawing is converted to wax model. 3. The wax is cast into a 21K or 22K gold jewelry. 4. Gold pieces are cleaned and polished. 5. Elements are assembled using hand tools and fine nozzle gas torches for soldering.
Reason: Gold is not a covered metal for the purpose of subheading 9802.00.60. As such the first requirement is not met. Having failed the first requirement, the jewelry has not met all four prerequisites and it is not eligible for special tariff treatment under subheading 9802.00.6000.
