BIS Officially Suspends Affiliates Rule for 1 Year, Effective Nov. 10
The Bureau of Industry and Security released a notice Nov. 10 officially suspending its Affiliates Rule for one year, as expected (see 2510310020). The stay of the rule, which applied Entity List prohibitions to unlisted entities owned at least 50% by companies on the Entity List, takes effect immediately.

The notice temporarily suspends “all changes previously made to the EAR by the Affiliates Rule” (see 2509290017) through Nov. 9, 2026. Effective Nov. 10, 2026, “and extending indefinitely,” those changes “will be added back into the” Export Administration Regulations.
During the one-year stay, “BIS will continue to evaluate U.S. national security and foreign policy interests related to these non-listed foreign affiliates of listed entities,” it said.
