USP Holdings, Inc., challenging CBP's denial of its protest claiming it was improperly denied Section 232 exclusions for its steel entries. # 25-00227. Filed Oct. 14.
Gladway Company, challenging CBP's denial of its protest claiming its food storage containers of Harmonized Tariff Schedule subheading 3923.90.0080, dutiable at 3%, and secondary subheading 9903.88.03, which comes with a 25% Section 301 duty, should be classified under subheading 3924.10.4000, dutiable at 3.4%. # 25-00228. Appeals of CIT Decisions
The following appeals of Court of International Trade decisions were recently filed at the U.S. Court of Appeals for the Federal Circuit:
Target General Merchandise Inc., appealing a September CIT decision finding the company's string light models are properly classified under HTS heading 9405 as lamps with a "permanently fixed light source" not specified elsewhere in the tariff schedule. # 26-1037. Opened Oct. 9.
BASF Corporation, appealing an August CIT decision finding the company's Betatene is properly classified under Harmonized Tariff Schedule subheading 2106.90.99 as a dietary supplement. # 26-1056. Opened Oct. 15.
Galleher Corp. and Galleher, LLC, appealing an August 2022 CIT decision remanding various elements of the Commerce Department's 2017 review of the countervailing duty order on multilayered wood flooring from China. # 26-1050. Opened Oct. 15.
