Aluminum Capacitor Foil Subject to AD/CVD on Aluminum Foil From China
Aluminum capacitor foil imported by Instrument Transformers is covered by antidumping and countervailing duty orders on aluminum foil from China, the Commerce Department said in an April 29 scope ruling.

The ruling covers both types of aluminum capacitor foil: master logs of unannealed foil and pre-slit annealed foil. Both are imported in reels greater than 25 pounds, made with alloy that is more than 99% aluminum and 0.005 millimeters thick.
The scope covers aluminum foil that is 2 millimeters thick or less and sold in reels that exceed 25 pounds in weight, regardless of whether lubricant has been applied to one or both sides of the foil.
Instrument Transformers argued that the language used by the orders’ petitioners indicated that aluminum capacitor foil wasn’t intended to be covered by said orders. The orders are directed at foil used in consumer and industrial settings for its insulating and reflective properties, it said. On the other hand, it said, aluminum capacitor foil is used to conduct electricity.
Commerce said it found the plain terms of the orders was enough for it to reach its decision. The orders do provide for three exclusions, but Instrumental Transformers' foil does not fall into any of them, it said. On the other hand, its products match the physical description of products covered by the orders, the department said.
