Commerce and CBP Announce New AD/CVD Functionality in ACE
CBP is adding a new functionality in ACE that will allow importers to identify entries that are the subject of an antidumping and/or countervailing duty certification and show that, for example, the goods aren't subject to AD/CVD orders, the Commerce Department said in a notice released Feb. 1. The new mechanism will be deployed on May 2 and will make AD/CVD entry summaries more "readily identifiable" to Commerce and CBP, the department said.

The additional declaration type code will be required on a "case-by-case basis," Commerce said. When Commerce "determines in the context of an AD/CVD proceeding that a certification is required," it "may determine, alone or in conjunction with other requirements, that the importer shall declare that its merchandise is being entered subject to a certification requirement using an additional declaration type code in ACE at the time of entry summary."
Commerce said that the code could represent that the entered merchandise is "entitled to a specific company AD and/or CVD rate" or that the merchandise is not subject to an AD and/or CVD order. The functionality will be "effective" May 2, Commerce said.
An upcoming CSMS message announcing the function will give more instructions on using the code, Commerce said.
