NCBFAA Says FDA Cosmetics Guidance Inadequate
The National Customs Brokers & Forwarders Association of America, which has complained that an end-of-year deadline for mandatory submissions to FDA on cosmetic product facility registrations and product listings is too rushed, said the draft guidance from the agency (see 2308080040) is inadequate to help importers comply.

The group wrote in its weekly newsletter issued Aug. 14: "The guidance does not answer most of NCBFAA's questions. Nothing is said about import entry requirements. For example, will the registration number of the foreign manufacturer be required as part of the Message Set? Will shipments be held up if they are not provided at entry?"
As NCBFAA presses the government for answers, it recommends that brokers share the guidance with clients who import cosmetics, and tell them to talk to their manufacturers about preparing for registering with FDA and providing information about the cosmetics' ingredients.
Companies will be able to submit this information electronically in October, FDA projects.
