ITC Changes Effective Dates for Repair or Replacement of Exercise Equipment in Exclusion Order

The International Trade Commission has reconsidered the implementation date of a repair or replacement exemption in a limited exclusion order and cease and desist orders on streaming video components (ITC Inv. No. 337-TA-1265), it said in a Federal Register notice released May 9. The orders targeted Icon Health & Fitness, FreeMotion Fitness, NordicTrack, Peloton Interactive, or any of their affiliated companies for importing exercise equipment with streaming video that infringed on three patents held by Dish (see 2303130005).

The commissioners found that the exemption for repair or replacement of products purchased by consumers "prior to the date of the orders" did not extend to U.S. consumers who may have purchased covered products during the presidential review period. Taking public interest into consideration, the ITC modified the exemptions in the exclusion order and in the cease-and-desist orders to take effect following the 60-day presidential review period rather than on March 8, as originally dated.
