CBP Set to Launch Automated Detention Notices in May, Including for Forced Labor

CBP will on May 20 deploy automated Form 6051D detention notices in ACE, including for Uyghur Forced Labor Prevention Act detentions, the agency said in an April 21 CSMS message. “This enhancement will give importers the ability to view, search, and respond to CBP Form 6051D using the ACE Forms application accessible through the ACE Secure Data Portal,” CBP said.

After the deployment, CBP will notify the broker and importer via an electronic courtesy notice, then file the CBP Form 6051D in ACE, including attachments, CBP said in an April 20 trade information notice. Importers will then “receive the 6051D through the ACE Forms application if they have an ACE Portal account and have selected ‘Portal’ as one of the options for Mode of Communication,” CBP said. “Otherwise, a 6051D will be mailed to them.”

Importers with ACE portal access “can then upload documentation and submit a response via the ACE Forms application. All uploaded documentation will be stored in the ACE Document Image System (DIS),” CBP said. “CBP will review and process the response from trade through ACE Forms.”

The Commercial Customs Operations Advisory Committee recommended that CBP automate its detention and seizure processes at the COAC’s December meeting (see 2212080030). A CBP official recently said automation would help address differences about how detentions are tracked manually across ports (see 2304190030).
