ITC Seeks Comments on Possible Exclusion Order on Automotive Lamps
The International Trade Commission is seeking public interest comments in a Section 337 investigation concerning a possible limited exclusion order on imported replacement vehicle lamps (ITC Inv. No. 337-TA-1292), according to a notice in the Federal Register released Feb. 3.

The investigation concerns replacement automotive lamps that allegedly infringe 21 design patents held by Hyundai's Kia. Kia asked for a limited exclusion order in December 2021 (see 2201210023). In his Jan. 24 initial determination, ITC Administrative Law Judge Clark Cheney found infringement of 17 of Kia's patents by TYC Brother Industrial of Taiwan, Genera of California, LKQ of Illinois and Keystone Automotive Industries of Pennsylvania, and recommended a limited exclusion order.
The ITC now seeks comments that address whether issuance of the recommended order would affect the public health in the U.S., competitive conditions in the U.S. economy, the production of like or directly competitive articles, or American consumers.
