ITC Issues Limited Exclusion Order on Electrolyte Containing Beverages

The International Trade Commission issued a limited exclusion order barring from entry certain electrolyte-containing beverages and their associated labeling and packaging imported by eight Mexican companies (ITC Inv. No. 337-TA-1269).

The exclusion order follows a finding by the ITC that all eight respondents were in default for having not replied to a May 2021 complaint, filed by Sueros y Bebidas Rehidratantes, S.A. de C.V. and CAB Enterprises and alleging that 11 named respondents were importing electrolyte beverages that infringed on four trademarks. The complaint was later dropped against three of the respondents. The investigation was terminated following the Nov. 2 commission vote to issue the order.
