In a second March 21 opinion, CIT dismissed a challenge to the antidumping investigation on silicon metal from Bosnia. Senior Judge Thomas Aquilinio ruled in favor of Commerce, holding that the agency was justified in not using the highest adverse facts available rate possible, instead basing the AFA rate on one of the respondent's financial statements.
