China Hardwood Plywood: Commerce Adds New Exemption for Door Stiles and Rails

The Commerce Department is adding a new exemption for certain door stiles and rails to the antidumping and countervailing duty orders on hardwood plywood from China (A-570-051/C-570-052), it said in a notice published June 2 announcing the final results of a changed circumstances review. In a change from its preliminary results of the review (see 2104060048), Commerce will apply the new exception retroactively to the dates that suspension of liquidation first took effect under these orders in 2017.

The exemption covers door stiles and rails made of laminated veneer lumber (LVL) that meet certain dimensional requirements. New language for the exemption is being added to the scope as follows: “Excluded from the scope of these Orders are certain door stiles and rails made of LVL that have a width not to exceed 50 millimeters, a thickness not to exceed 50 millimeters, and a length of less than 2,450 millimeters.”

The Coalition for Fair Trade in Hardwood Plywood, which filed the original petition on AD/CV duties on hardwood plywood, requested the exemption. It says the door stiles and rails are better covered by imminent AD/CVD orders on wood mouldings and millwork (see 2101270050).

“Because we determine that there are changed circumstances that warrant the revocation of the Orders, in part, we will instruct CBP to liquidate without regard to AD and CVD duties, and to refund any estimated AD and CVD duties, on all unliquidated entries of the merchandise covered by these partial revocations effective April 25, 2017, for purposes of the CVD Order and June 23, 2017, for purposes of the AD Order,” Commerce said.
