Seamless Pipe: Commerce Issues AD Duty Final Determination for Czech Republic

The Commerce Department issued its final determination in the antidumping duty investigation on seamless carbon and alloy steel standard, line, and pressure pipe from the Czech Republic (A-851-804). Cash deposit rates set in this final determination take effect March 5, the date it is scheduled for publication in the Federal Register.

The next step is for the International Trade Commission to make its final injury determination, currently scheduled for April 15, according to a Commerce fact sheet. If the ITC finds injury, Commerce will issue an AD duty order and duties will be made permanent. If the ITC finds no injury, the investigation will be terminated and all cash deposits will be refunded.

Commerce is also conducting countervailing duty investigations on seamless pipe from South Korea and Russia, as well as AD duty investigations on seamless pipe from South Korea, Russia and Ukraine. Commerce issued its preliminary determinations in those investigations in December and February, respectively (see 2012100053 and 2102090025).

Scope Exemptions Added for OCTG, A-335 Pipe

As announced in its preliminary AD duty determinations for South Korea, Russia and Ukraine, Commerce is adding exclusions to the scope for oil country tubular goods, as well as for A-335 pipe and pipe meeting the comparable GOST 550-75 specification. The exclusions were requested by the TMK Group, a respondent in the Russia investigation, and unopposed by the domestic petitioners. The new scope language is as follows:

“Also excluded from the scope of the investigations are: (1) oil country tubular goods consisting of drill pipe, casing, tubing and coupling stock; (2) all pipes meeting the chemical requirements of ASTM A-335 regardless of their conformity to the dimensional requirements of ASTM A-53, ASTM A-106 or API 5L; and (3) the exclusion for ASTM A335 applies to pipes meeting the comparable specifications GOST 550-75.”

Estimated AD Cash Deposit Rates

Commerce will instruct CBP to continue to suspend liquidation of subject merchandise entered on or after Dec. 21, the date the agency issued its preliminary determination in this investigation, and require an AD duty cash deposit equal to the following AD rates beginning March 5 (unchanged from preliminary rates):
