Dec. 16 CBP Bulletin Proposes to Modify Rulings on Polymer Products

In the Dec. 16 Customs Bulletin (Vol. 54, No. 49), CBP published notices that propose to modify rulings on polymer products A312A-9010-W and A312A-NP-W.

Comments on Proposals Due Jan. 15

CBP said consideration will be given to any written comments received by Jan. 15, 2021, before taking these actions. In addition, any party that has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Polymer Products

Item: Molding resins consisting of acrylonitrile-butadienestyrene (ABS) copolymer CAS-9003-56-9 that will be imported in pellet form for use in the manufacture of plastic products. They will also contain flame-retardant additives.
Current: 3903.30.00, 6.5%, “Polymers of styrene, in primary forms: Acrylonitrile-butadiene-styrene (‘ABS’) copolymers.”
Proposed: 3903.90.50, 6.5%, “Polymers of styrene, in primary forms: Other: Other.”
Reason: The two copolymers do not contain 95% or more of the monomers acrylonitrile, butadiene, and styrene, as required by subheading Note 1(a)(2) to chapter 39.
