July 22 CBP Bulletin Proposes to Revoke Ruling on Ceramin Mineral Board

Comments on Proposals Due Aug. 21

CBP said consideration will be given to any written comments received by Aug. 21 before taking this action. In addition, any party that has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Ceramin Mineral Board

Item: Ceramin mineral board comprised of natural talc mixed with thermoplastic, plus minor amounts of ink and lacquer, measuring approximately 1.28 meters long by 1.3 meters wide by 3 to 5 mm thick, designed for residential and commercial flooring and wall paneling.
Current: 6810.19.14, 9%, “Articles of cement, of concrete or of artificial stone, whether or not reinforced: Tiles, flagstones, bricks and similar articles: Other: Floor and wall tiles: Other.”
Proposed: 6815.99.40, free, “Articles of stone or of other mineral substances (including carbon fibers, articles of carbon fibers and articles of peat), not elsewhere specified or included: Other articles: Other: Other.”
Reason: Because the polymer binder is agglomerated with mineral rather than stone, the Ceramin Mineral Board cannot be classified in heading 6810.
