Oct. 30 CBP Bulletin Proposes to Modify Rulings on Mattress Covers, Spirits

In the Oct. 30 Customs Bulletin (Vol. 53, No. 39), CBP published notices that propose to revoke or modify rulings and similar treatment for mattress covers and spirits.

Comments on Proposals Due Nov. 29

CBP said consideration will be given to any written comments received by Nov. 29 before taking this action. In addition, any party who has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Mattress Covers

Item: Multiple types of stuffed mattress covers
Current: The country of origin for all of the covers is El Salvador.
Proposed: The country of origin of the good is the last country, territory or insular possession in which an important assembly or manufacturing process occurred.
Reason: Since the fabric for the mattress covers is formed in multiple countries, and no one fabric is more important than the other, the country of origin cannot be readily determined based on the fabric making process.

Spirits

Item: “Pernod Absinthe Superieure” and “Ricard Pastis de Marseille”
Current: 2208.70.0030, Free, “Undenatured ethyl alcohol of an alcoholic strength by volume of less than 80 percent vol.; spirits, liqueurs and other spirituous beverages: Liqueurs and cordials: In containers each holding not over 4 liters.”
Proposed: 2208.90.7500, Free, “Undenatured ethyl alcohol of an alcoholic strength by volume of less than 80 percent
vol.; spirits, liqueurs and other spirituous beverages: Other: Other: Spirits: Other."
Reason: “Pernod Absinthe Superieure,” which contains no sugar content, and “Ricard Pastis de Marseille,” which contains under one percent sugar content, do not meet the requisite sugar content to be classified as a liqueur or cordial because they both contain under 2.5 percent sugar content.
