Sept. 25 CBP Bulletin Proposes to Revoke, Modify Rulings on Stretcher and Gurney Covers, Printed Plastic Sheet

In the Sept. 25 Customs Bulletin (Vol. 53, No. 34), CBP published notices that propose to revoke or modify rulings and similar treatment for stretcher and gurney covers and a plastic sheet with a printed numeral.

Comments on Proposals Due Oct. 25

CBP said consideration will be given to any written comments received by Oct. 25 before taking this action. In addition, any party who has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Stretcher and Gurney Covers

Item: Stretcher and gurney covers made of non-woven polypropylene
Current: 6307.90.98, 7%, “Other made up articles, including dress patterns: Other: Other.”
Proposed: 6302.32.20, 11.4%, “Bed linen, table linen, toilet linen and kitchen linen: Other bed linen: Of man-made fibers: Other.”
Reason: The definition of bed linens in heading 6302 does not exclude specialized items only for use of some beds, and is not limited to only linen fabric.
Proposed for revocation: NY B89677 (1997), NY I88978 (2002)
Proposed new ruling: HQ H254033

Plastic Sheet With a Printed Numeral

Item: A clear plastic sheet about 7 inches by 3-3/8 inches, printed with the numeral "3" that is formed by printing a black background that leaves the shape of the numeral. The sheet will be used in a light panel assembly that functions as an illuminated address sign.
Current: 3926.90.99, 5.3%, “Other articles of plastics and articles of other materials of headings 3901 to 3914: Other: Other.”
Proposed: 4911.99.80, free, “Other printed matter, including printed pictures and photographs: Other: Other: Other: Other.”
Reason: Although the numerals are delineated by the absence of the black printing on the clear sheet, the numerals are formed by the printing process. They are not colored or repetitive-design printed (which would exclude them from chapter 49).
