LKQ Corporation and Keystone Automotive Industries, challenging CBP's seizures of its aftermarket automotive repair grilles. CBP seized the grilles for alleged intellectual property rights violations, but LKQ argues the auto grilles did not violate intellectual property laws. #19-00176. Filed Sept. 20.
Pennsylvania National Mutual Casualty Insurance Company, challenging CBP's demands for unpaid duties on entries of steel wire garment hangers. Pennsylvania Mutual argues the bond contracts were invalid because of CBP's failure to provide notice of the suspension of liquidation, CBP's failure to conduct a risk assessment, CBP's failure to take additional measures upon reasonable suspicion and CBP's failure to produce adequate data to the surety. #19-00177. Appeals of CIT Decisions
The following appeals of Court of International Trade decisions were filed at the U.S. Court of Appeals for the Federal Circuit during the week of Sept. 16-22:
U.S. government, appealing a July 25 CIT decision that sustained Commerce's redetermination that zinc and nylon masonry anchors imported by Simpson Strong-Tie are not nails and are not subject to antidumping duties on steel nails from China. #19-2403. Opened Sept. 17.
