Oct. 3 CBP Bulletin Proposes to Revoke Rulings on Electronic Flashing Buttons, Grinding Mill Beads

In the Oct. 3 Customs Bulletin (Vol. 52, No. 40), CBP published notices that propose to revoke rulings and similar treatment for electronic flashing buttons and grinding mill beads.

Comments on Proposals Due Nov. 2

CBP said consideration will be given to any written comments received by Nov. 2 before taking this action. In addition, any party who has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Electronic Flashing Buttons

Item: A circular piece of hard plastic with four rapidly flashing LED lights that draw attention to, and illuminate, a decorative expression.
Current: 8543.70.9650, 2.6%, “Electrical machines and apparatus...: Other machines
and apparatus: Other: Other: Other: Other.”
Proposed: 7117.90.7500, Free, “Imitation jewelry: Other: Valued over 20 cents per dozen pieces or parts: Other: Of plastics.”.”
Reason: The electronic flashing button features a pin or clip upon which the button is mounted, and is of a type of pin or clip that is routinely affixed to jewelry pins or brooches that are worn on a lapel or shirt. Therefore, the electronic flashing buttons are prima facie classifiable in heading 7117.

Grinding Mill Beads

Item: Ceramic beads that are used in grinding mills to grind marble to a one micron size.
Current: 6909.11.20, Free, “Ceramic wares for laboratory, chemical or other technical uses, of porcelain or china, machinery parts.”
Proposed: 6909.19.5095, 4%, "Ceramic wares for laboratory, chemical or other technical
uses; ceramic troughs, tubs and similar receptacles of a kind used in agriculture; ceramic pots, jars and similar articles of a kind used for the conveyance or packing of goods: Ceramic wares for laboratory, chemical or other technical uses: Other: Other.”
Reason: The product at issue is composed of vitrified Zirconium oxide and silicon oxide and does not contain clay materials, CBP said. The “porcelain” subheading does not apply and the product is placed in the “other” subheading.
