May 9 CBP Bulletin Proposes to Modify or Revoke Rulings on Knife Care Sets, Decorative Pillows

In the May 9 Customs Bulletin (Vol. 52, No. 19), CBP published notices that propose to modify or revoke rulings and similar treatment for knife care sets and decorative pillows.

Comments on Proposals Due June 8

CBP said consideration will be given to any written comments received by June 8 before taking this action. In addition, any party who has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Knife Care Sets

Item: Knife care kit with three black micro polishing cloths made from cotton, one Uchiko talc powder ball, one 2-ounce bottle of food grade oil, five polishing sticks (buffing wands), and one wooden storage box. Each polishing stick is composed of three different grits: grey for fine, red for medium and white for coarse.
Current: 7116.20.4000, 10.5%, “Articles of natural or cultured pearls, precious or semi-precious stones

Proposed: 6815.99.20, free, “Articles of stone or of other mineral substances (including carbon fibers, articles of carbon fibers and articles of peat), not elsewhere specific or included: Other articles: Other:
Talc, steatite and soapstone, cut or sawed, or in blanks, crayons, cubes, disks or other forms.”
Reason: The polishing cloths and the talc powder ball both impart the essential character of the knife care set. The talc powder ball is last in numerical order compared to the polishing cloths, and the entire knife care set is classified in heading 6815.
Proposed for revocation: NY N245711 (2013)
Proposed new ruling: HQ H293248

Decorative Pillows

Item: Decorative pillows from China that are filled in Mexico.
Current: Not eligible for preferential treatment under NAFTA.
Proposed: Eligible for NAFTA.
Reason: "The decorative pillows are a product of Mexico under the 'NAFTA preference override' since they undergo more than 'minor processing,'" CBP said.

Proposed new ruling: HQ H290258, HQ H293880, and HQ H293881
