Nov. 1 CBP Bulletin Proposes to Modify Rulings on Piston Pin Bushings, Fork Lift Load Roller

In the Nov. 1 Customs Bulletin (Vol. 51, No. 44), CBP published notices that propose to modify rulings and similar treatment for piston pin bushings and a fork lift load roller.

Comments on Proposals Due Dec. 1

CBP said consideration will be given to any written comments received by Dec. 1 before taking this action. In addition, any party who has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Piston Pin Bushings

Item: Piston pin bushings that are designed for installation in automotive diesel engines. A piston pin, also called a wrist pin, is the cylindrical or tubular metal piece that attaches the piston to the connecting rod. The bushing for the piston pin is a sleeve placed in a bore to serve as a bearing surface.
Current: 8409.99.91, 3.7%, ”Parts suitable for use solely or principally with the engines of heading 8407 or 8408: Other: Other: Other: For vehicles of subheading 8701.20, or heading 8702, 8703 or 8704.”
Proposed: 8483.30.80, 4.5%, “Transmission shafts (including camshafts and crankshafts) and cranks; bearing housings, housed bearings and plain shaft bearings ...: Bearing housings; plain shaft bearings; Other.”
Reason: Note 2 to Section XVI says parts of machines are classified in their respective headings if they are parts of goods included in any headings of Chapter 84 or 85 (other than heading 8409). The piston pin bushing is placed into a bore to keep a piston pin in place by serving as a bearing surface. That function is akin to that of a plain shaft bearing provided for under heading 8483 in that the pin rotates against the inside of the bushing for anti-friction and anti-wear purposes.

Fork Lift Load Roller

Item: An inner metal ring that is surrounded by round metal balls that are in turn surrounded by an outer metal ring, used as tires on which fork lift masts roll. The complete load roller is shaped like a round disc with a hole in the center, somewhat resembling a donut.
Current: 8431.20.00, free, "Parts suitable for use solely or principally with the machinery of headings 8425 to 8430: Of machinery of heading 8427... .”
Proposed: 8482.10.50, 9%, “Ball or roller bearings, and parts thereof: Ball bearings: Other... .”
Reason: Note 2 to Section XVI says parts of machines are classified in their respective headings if they are parts of goods included in any headings of Chapter 84 or 85 (other than heading 8409). The fork lift load roller is a roller bearing that is properly classified under heading 8482
