Incase Design, on the classification of mini car chargers and high-speed mini car chargers with a lightning to USB connector. CBP classified the merchandise under subheading 8504.40.9550 (1.5%). Incase says it should have instead been classified under subheading 8504.40.8500 (free). #17-046. Filed March 13.
United States, seeking $854,005.12 in unpaid excise taxes on cigars and cigarillos imported by Mariola International Company. The complaint alleges Mariola based its excise tax payments on the manufacturer's sales price, not the final sales price to the consumer. #17-047. Filed March 15.
Vertigo Interiors, challenging CBP's exclusion from entry of its of office chairs and other furniture products. Vertigo alleges CBP detained the goods to determine admissibility, but did not make the admissibility determination within 30 days, resulting in the goods being deemed excluded. #17-048. Filed March 15.
United States, seeking $307.767.49 in unpaid duties and a $1,111,351.24 penalty from Great Neck Saw Manufacturers for negligent and grossly negligent undervaluation of its imported hand tools. The complaint alleges Great Neck improperly deducted buying commissions that were not bona fide from the transaction value. #17-049. Filed March 17.
