Aug. 24 CBP Bulletin Proposes to Revoke Rulings on Cam Fastener and Dowel, Aircraft Engine

In the Aug. 24 issue of the CBP Customs Bulletin (Vol. 50, No. 34) (here), CBP published notices that propose to revoke or modify rulings and similar treatment for the classification of a cam fastener and dowel made of zinc and an aircraft engine.

Comments on Proposals Due Sept. 23

CBP said consideration will be given to any written comments received by Sept. 23 before taking this action. In addition, any party who has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Cam Fastener and Dowel

Item: A cam fastener and dowel, made of zinc with the shaft of the dowel encased in plastic, used to fasten or bind parts of furniture together and also to fasten other items such as wall shelving units. The cam fits into a hole, usually in a wooden piece of furniture, and that the dowel also fits into a hole in a second piece of unassembled furniture that is placed perpendicular to the first piece.
Current: 9403.90.80, duty-free, "Other furniture and parts thereof: Parts: Other: Other: Other: Of metal: Other."
Proposed: 7907.00.60, 3%, “Other articles of zinc: Other."
Reason: The cam fasteners and dowels are parts of general use excluded from classification in chapter 94. They are similar to steel cam fasteners and dowels classified in heading 7318, which is listed as an exemplar of parts of general use in the tariff schedule. They are also able to be used to fasten wall shelving units in addition to furniture, so are not designed for a single article.

Aircraft Engine

Item: Rolls Royce M250-C20B model engine
Current: 8411.81.8000, 2.5%, "Turbojets, turbopropellers and other gas turbines, and parts thereof: Other gas turbines: Of a power not exceeding 5,000 kW: Other."
Proposed: 8411.81.40, duty-free, “Turbojets, turbopropellers and other gas turbines, and parts thereof: Other gas turbines: Of a power not exceeding 5,000 kW: Aircraft turbines.”
Reason: The importer submitted new evidence, including an operation manual that refers to aircraft and evidence that the engine is subject to the regulations of the Federal Aviation Administration. CBP found the engine, as imported, is solely for use on helicopters, rather than a dual-use engine for aircraft and industrial applications.
