DC Circuit Sets Oral Argument in Net Neutrality Case for Dec. 4

Oral argument on challenges to the FCC net neutrality order is set for Dec. 4, the U.S. Court of Appeals for the D.C. Circuit said in a short order Monday. The composition of the three-judge panel will usually be revealed 30 days before oral argument, noted the order, and a separate order will be issued on time allocations in the case (USTelecom v. FCC, No. 15-1063).

Telco and cable petitioners presented their case Thursday against the FCC order imposing net neutrality rules and broadband reclassification under Title II of the Communications Act; and Full Service Network made its arguments against the FCC decision to give broadband providers forbearance regulatory relief (see 1507310042).

Intervenor and amicus briefs supporting petitioners are due Thursday. Under the court's schedule, the FCC and the Department of Justice are to respond by Sept. 14, reply briefs from petitioners are due Oct. 5 and final briefs incorporating an appendix are due Oct. 13 (see 1506290029).
