United States requesting penalties and unpaid duties totaling up to $1,000,000 under 19 USC 1592 from Sigma Plastics, Lexon Insurance, Eve Farlin Ng and Tjun Hong for grossly negligent and negligent misclassification of plastic bags and a double-invoicing scheme to avoid antidumping duties. #15-00171. Gang Yan Diamond Products and Beijing Gang Yan Diamond Products Company challenging the Commerce Department's final results of 2012-13 antidumping duty administrative review on diamond sawblades and parts thereof from China. #15-00173. Filed June 22.

Aero Rubber Company, Inc. on the classification of its printed silicone bands. CBP classified the merchandise under subheading 3926.90.9980 (5.3%). Aero says it should have instead been classified under subheading 4911.10.0080 (free) or 4911.99.8000 (free). #15-00174. Filed June 22.

New Image Global challenging whether customs correctly calculated the weight of its imported tobacco products and assessed the correct internal revenue tax. #15-00175. Filed June 22.

Pet Life LLC on the classification of its pet carriers. CBP classified the merchandise under subheading 4202.92.9026 (17.6%). Pet Life says it should have instead been classified under subheading 6307.90.9889 (7%). #15-00176. Filed June 24.

Golden Dragon Precise Copper Pipe Group, Inc.; Hong Kong GD Trading Co., Ltd.; Golden Dragon Holding (Home Kong) Int'l Ltd.; and GD Copper (U.S.A.), Inc., challenging the Commerce Department's final results of 2012-13 antidumping duty administrative review on seamless refined copper pipe and tube from China. #15-00177. Filed June 24.

M. Brashem, Inc. challenging CBP's liquidation of its entries despite the fact that they were subject to an injunction against liquidation issued in a court case on antidumping duties on small diameter graphite electrodes. #15-00178. Filed June 24.

Shenzhen Xinboda Industrial Co., Ltd. challenging the Commerce Department's final results of 2012-13 antidumping duty administrative review on fresh garlic from China. #15-00179. Filed June 25.

Hartford Fire Insurance challenging CBP claims on bonds covering entries of honey. Hartford says the bonds should be canceled because they contained errors. #15-00180, -00181. Filed June 26.

Hebei Golden Bird Trading Co., Ltd.; Jinxiang Richfar Fruits & Vegetables Co., Ltd.; Qindao Lianghe International Trade Co., :Ltd.; Shandong Chenhe International Trading Co., Ltd.; and Weifang Hongqiao International Logistics Co., Ltd., challenging the Commerce Department's final results of 2012-13 antidumping duty administrative review on fresh garlic from China. #15-00182. Filed June 26.

Appeals of CIT Decisions

The following appeals of Court of International Trade decisions were filed at the U.S. Court of Appeals for the Federal Circuit during the week of June 22-28:

Best Key Textiles Co., Ltd. appealing CIT's refusal to transfer its case to the U.S. District Court for the District of Columbia. The Federal Circuit ruled in February that Best Key could not challenge a ruling revocation that reclassified Best Key's metallic yarn in a way that reduced the immediate duty payable, but increased the duty rate for apparel made from the yarn, because it only suffered indirect injury (see 1502030060).
