CBP Outlines Penalty Policies for Incorrect Date of Export Filing

CBP will issue penalties when cargo is exported prior to filing of Electronic Export Information though the Automated Export System, said CBP's Port of New York/Newark office in a June 17 informational pipeline. The pipeline establishes a "national policy and defines the parameters under which penalties will be issued against the U.S. Principal Parties In Interest (USPPI), the Foreign Principal Parties in Interest (FPPI) or their authorized agent, for reporting incorrect date of export," it said.

CBP may also penalize exporters when the listed date of export is five or more days prior to the actual date of export, it said. CBP won't issue a penalty if the date of export in the EEI is between one and four days prior to the actual date of export. "It is the responsibility of the USPPI or their authorized agent to update the EEI submission to reflect the correct date of export," said CBP. "No penalty will be issued if the date of export is updated prior to, or on the date of export." Such penalties against and exporter or authorized agent may be waived based on sufficient documentation to prove "they are not the party responsible for the violation," said CBP.
