Census Outlines AES Changes Related to Approaching Implementation of ECR Rules

The Export Control Reform rule set to revise the U.S. Munitions List (USML) and place some dual use items in new “600 series” Export Control Classification Numbers (ECCNs) on the Commerce Control List (CCL) on July 1 will require exporters to make several changes to Automated Export System filing, the Census Bureau said in a June 3 release. This final rule was published on Jan. 2 (see 14010302). The following Export Control Classification Numbers will be added to AES reference tables: 0A604, 0A614, 0B604, 0B614, 0D604, 0D614, 0E604, 0E614, 1A613, 1B608, 1B613, 1C608, 1D608, 1D613, 1E608, 1E613, 9A604, 9B604, 9D604, and 9E604.

Census is also instructing AES filers to determine whether their ECCNs are eligible for the some AES License Type Codes. AES will generate Fatal Error 666 (ECCN MUST BE FROM APPROVED LIST) if the “600 series” ECCNs are reported under any ineligible AES License Type Code. With the exception of “600 series” .y paragraph exports under AES License Type Code C60, an AES filing is required for exports of items classified under “600 series” ECCNs, regardless of the value of the item or destination.

The Export Control Reform rule set to transfer export controls on radiation-hardened and other microelectronic circuits on June 27 will also require exporters to make several changes in AES filing. That final rule was published on May 13 (see 14051224). The following ECCNs will be added to AES reference tables: 9A515, 9D515, and 9E515.

Census is also instructing AES filers to determine whether ECCNs covered by the microelectronics circuit rule are eligible for certain AES License Type Codes. AES will generate Fatal Error 666 (ECCN MUST BE FROM APPROVED LIST) if ECCNs are reported under any ineligible AES License Type Code. Census requires AES filing of exports of all items classified under ECCNs 9A515, 9D515, and 9E515, regardless of the value of the item or destination.

Software providers or companies with in-house software programs designed to interface directly with AES may now test AES changes, including the acceptance of the new 9A515, 9D515, 9E515, and “600 series” ECCNs, as well as the new AES License Type Code C60 (DY6) for .y paragraph items of the “600 series” ECCNs, said Census.
