Florida Tomato Exchange Files Legal Challenge to U.S./Mexico AD Suspension Agreement

The Florida Tomato Exchange (FTE) is challenging the Commerce Department's agreement with Mexican tomato growers to suspend an antidumping investigation on fresh tomatoes from Mexico. The FTE filed its complaint April 19 in the Court of International Trade, alleging that Commerce was operating outside of the statute when it entered into a fourth suspension agreement and revised reference prices.

The group also said several of Commerce's determinations, including on dumping and injurious effects, are not supported by evidence. The FTE asks that the CIT judge to declare that "Commerce erred in its determination to suspend the investigation" on fresh tomatoes from Mexico. Last month, the Commerce Department and Mexican tomato growers finalized an agreement to avert resumption of an antidumping duty investigation of fresh tomatoes from Mexico. (See 13030522).
