China Cased Pencils: ITA Excludes Novelty Drumstick Pencils from AD Order

The International Trade Administration revoked, in part, the antidumping duty order on certain cased pencils from China (A-570-827) to exclude novelty pencils shaped like drumsticks from the AD duty order. Effective June 1, 2011, pencils that are shaped like drumsticks, do not contain erasers, and are longer than regular wooden pencils are no longer subject to the AD duty order on cased pencils from China. The ITA made no changes from its preliminary results of changed circumstances review, which recommended partial revocation.

ThinkGeek, Inc., a U.S. importer of subject merchandise, requested the changed circumstances review and revocation in part. The U.S. pencil industry expressed no interest in inclusion of drumstick novelty pencils under the AD duty order. No parties filed comments after the preliminary results.

ITA Adds Exception to Scope of AD Order

The ITA added the following sentence to the scope of the AD duty order on cased pencils from China: “Also excluded are novelty drumstick pencils that are shaped like drumsticks, longer than regular wooden pencils, and do not contain erasers.”

CBP to Liquidate Unliq Entries of Drumstick Entries, Refund Cash Deposits

The ITA will instruct CBP to liquidate, without regard to AD duties, all unliquidated entries of novelty drumstick pencils entered, or withdrawn from warehouse, for consumption on or after June 1, 2011. The ITA will also instruct CBP to refund any cash deposits collected with respect to these entries.
