China Cased Pencils: Prelim Results of AD Changed Cir Review

The International Trade Administration issued the initiation and preliminary results of its antidumping duty changed circumstances review of certain cased pencils from the People's Republic of China (A-570-827), in response to a request by U.S. importer of subject merchandise ThinkGeek, Inc. that the ITA revoke, in part, the AD order with respect to novelty drumstick pencils. The ITA said the domestic industry has affirmatively expressed a lack of interest in the continuation of the order with respect to this product. Therefore, The ITA intends to revoke, in part, the AD order as it relates to imports of these novelty drumstick pencils.

The ITA is asking for comments on these preliminary results from interested parties by about July 31, 2012.

ITA Intends to Add Exceptions to Scope

ThinkGeek asks the ITA to exclude pencils meeting the following characteristics from the AD order on certain cased pencils from China:

  • Novelty drumstick pencils that are shaped like drumsticks, longer than regular wooden pencils, and do not contain erasers.

AD Cash Deposit Still Required; If Results Same in Final, CBP to End Susp of Liq

If final revocation occurs, the ITA will instruct U.S. Customs and Border Protection to end the suspension of liquidation for the merchandise covered by the revocation on the effective date of the notice of revocation and to release any cash deposit or bond. The ITA has preliminarily determined this effective date to be June 1, 2011. The current requirement for a cash deposit of estimated AD duties on all subject merchandise will continue unless and until it is modified pursuant to the final results of this changed circumstances review.
