EPA Final TSCA Test Rule for 15 HPV Chemicals (Group 3: Lard, Oil, Ethanol, Etc.)

The Environmental Protection Agency has issued a final rule, effective November 21, 2011, to require manufacturers, importers, and processors to conduct certain testing to obtain screening level data for health and environmental effects and chemical fate for 15 high production volume (HPV) chemical substances. EPA states that this test data is needed in order to help it to determine whether these 15 HPV chemical substances pose a risk to human health and/or environmental safety.

In addition, any person who exports, or intends to export, any of the chemical substances included in this final rule will be subject to the export notification requirements in 40 CFR part 707, subpart D.

(This is the third HPV “test rule” under section 4(a)(1)(B) of the Toxic Substances Control Act (TSCA) in a series of “HPV Challenge” rulemakings that have occurred since 2006 in which companies have been "challenged" to make health and environmental effects data publicly available on chemicals produced or imported in the U.S. in the greatest quantities. EPA is simultaneously proposing its fourth and final HPV test rule along with a proposed significant new use rule (SNUR). See ITT’s Online Archives 11102720 for summary.

HPV chemicals are considered those with a production/import volume equal to or greater than 1 million pounds (lbs) per year.)

Mfrs/Importers of 15 HPVs Must Test in Accordance with Rule or Seek Exemption

Those that manufacture (including import) or process, or intend to manufacture or process, one or more of the following 15 chemical substances at any time from November 21, 2011 to the end of the test cost reimbursement period may be required to test them (possibly through a consortia) in accordance with the tests listed below or to seek an exemption from the testing. The required testing must be initiated in time to allow the required final report to be submitted within 13 months of the effective date or by December 21, 2012.
