If No Review Request, CBP to Assess AD/CV Duties Equal to Deposit Estimate

If the ITA does not receive, by October 31, 2011, a request for an administrative review of entries covered by an AD or CV duty order or suspension agreement listed above for the identified review period, it will instruct U.S. Customs and Border Protection (CBP) to assess AD/CV duties on those entries at a rate equal to the cash deposit of (or bond for) estimated AD/CV duties required on those entries at the time of entry, and to continue to collect the cash deposit previously ordered.

ITA’s Clarified Policy on Assessing AD Rates for Certain Resellers/Intermediaries

The ITA further notes that in May 2003 it clarified its practice with respect to the collection of final AD duties on imports of merchandise (from countries other than NME countries) where intermediate firms are involved.

(See ITT's Online Archives 03060245 for summary of ITA's notice on its automatic liquidation regulation regarding resellers. See ITT's Online Archives 06031015 for summary of the ITA's policy.)
