Increased CPSC Activity May be due to Commissioner Moore's Oct Term End

Commissioner Nord and other Consumer Product Safety Commission officials have suggested that the agency’s recent flurry of activity, including the consideration of four1 significant notices in the next few weeks, is likely triggered by Commissioner Moore’s upcoming departure at the end of October 2011. With Moore leaving, the Commission would have two Democratic and two Republican Commissioners remaining, which could increase the likelihood of tied votes.

1There are four significant notices related to testing, certification, and labeling of consumer products being considered in the next two weeks. These are: (i) a notice seeking comments on ways to reduce the CPSIA third-party testing costs; (ii) a draft final rule on initial testing and certification of children’s products, periodic and material change testing, and voluntary consumer product labeling; (iii) a draft final rule on relying on component part testing or certification, or another party’s finished product testing or certification, to meet the CPSIA testing and certification requirements; and (iii) a draft proposed rule that would provide for the testing of representative (instead of random) samples for children’s product continued compliance testing.
