BIS to Hold Weekly Phone Calls on "USML to CCL" Proposed Rule

The Commerce Department’s Assistant Secretary for Export Administration will be holding weekly teleconferences, beginning July 27, 2011, to discuss BIS’ recently published proposed rule to, among other things, create a framework for controlling militarily less significant defense articles on the Commerce Control List rather than the U.S. Munitions List. Questions must be submitted in advance.

BIS’ proposed rule addresses the treatment of militarily less significant items after they move from State (USML) to Commerce (CCL) jurisdiction. The proposed rule would also create a new “600” series of Export Control Classification Numbers (ECCNs) in the CCL to accommodate the transfer of products, parts and components from the USML, and a single definition of “specially designed.” (See ITT’s Online Archives or 07/13/11 and 07/15/11 news, 11071318 and 11071519, for BP summaries of the BIS “USML to CCL” proposed rule.)

Will Also Address License Exception STA Final Rule

Assistant Secretary for Export Administration Kevin Wolf will also be available to discuss questions regarding the use of License Exception Strategic Trade Authorization (STA), which was recently added to the Export Administration regulations in a June 16, 2011 final rule.

BIS’ STA final rule is the first step in implementing the Administration’s vision of eliminating easy cases, so the U.S. Government can focus its limited resources on items and end users that require more attention. STA facilitates trade and interoperability with the closest U.S. allies. The reduced licensing requirements in the final rule are accompanied by new safeguards however, to ensure that eligible items are not reexported outside this group of countries without U.S. Government authorization. Teleconferences Begin July 27

The BIS teleconferences will be held on Wednesdays, beginning July 27, 2011 through September 7, 2011, from 2:00 pm -- 3:00 pm EST, to answer questions on issues related to these two BIS notices and other Export Control Reform (ECR) topics.

Questions Must be Submitted in Advance, No Reservations Required

According to BIS, the Assistant Secretary will not answer questions unless they are submitted in advance. BIS requests that questions be sent to oesdseminar@bis.doc.gov, subject line: “Teleconference questions.”

BIS states that the trade can participate in the free conference calls by dialing in 888-455-4959, Participant Code: 6652660 and that no reservations are required. According to BIS, callers should dial in 10 minutes early.
