Order Revoked due to ITC Negative Injury Determination Under Sunset Review

The ITA is revoking the AD duty order on magnesium metal from Russia as a result of the determination by the ITC that revocation of this AD duty order is not likely to lead to continuation or recurrence of material injury to an industry in the U.S. within a reasonably foreseeable time.

Suspension of Liquidation/Cash Deposits Terminated Effective Apr 15, 2010

The effective date of revocation is April 15, 2010. The ITA will issue instructions to U.S. Customs and Border Protection, within 15 days after March 10, 2011, to terminate the suspension of liquidation and collection of cash deposits on merchandise subject to the order with a time of entry on or after April 15, 2010.

ITA Will Conduct Requested Reviews on Entries Prior to Apr 15, 2010

The ITA will complete any pending administrative review of this order and will conduct administrative reviews of subject merchandise entered prior to April 15, 2010 in response to appropriately filed requests for review.

1The merchandise covered by the order is magnesium metal (also referred to as magnesium), which includes primary and secondary pure and alloy magnesium metal, regardless of chemistry, raw material source, form, shape, or size, and is currently classifiable under HTS 8104.19.00, 8104.30.00, and 8104.90.00.
