Iran Pistachios: ITA Tolls AD Sunset Review Pursuant to Import Ban

In the International Trade Administration's December 2010 notice of initiation of five-year Sunset Reviews, it states that it is not initiating a review of the antidumping duty order on raw pistachios from Iran (A-507-502) as scheduled, pursuant to the ban on all imports from Iran.

Iran Sanctions Act Bans All Iran Imports Effective Sept 29

The ITA was scheduled to initiate the sunset review of the subject AD duty order; however, the recently enacted Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 (H.R. 2194, Public Law 111-195) includes a ban on all U.S. imports from Iran, including pistachios, effective September 29, 2010.

ITA Cannot Initiate Sunset Review Until 2 Months After Ban is Lifted

While the import ban remains in effect, the five-year period from the date of the ITA’s prior determination to continue the order in effect is tolled. Accordingly, the ITA may not initiate a sunset review of the AD duty order on raw pistachios from Iran until two months after the import ban on pistachios is lifted.
