FY 2011 Refined and Specialty Sugar TRQ Oversubscribed at Opening

CBP has issued a memorandum announcing that the fiscal year 2011 specialty sugar tariff rate quota that opened on October 1, 2010 oversubscribed at opening moment. The pro rata percentage is 52.00666% or 0.520066.

Entries or withdrawals for consumption for specialty sugar presented after the opening should be returned to the broker for amendment. To facilitate release of shipments, HQ Quota will not allow filers to re-transmit amended entries. Filers should submit a corrected CBP Form 7501, and the ports will update the entry summary line information. It may be necessary to add additional lines in order to accurately reflect the amendment.

CBP states HQ Quota should be notified, via email, by October 14, 2010, what percentage allocation the importer elects to take. Provided that the importer has not taken custody of the shipment, the importer has the option to distribute the prorated allocation on a given entry (i.e., more or less than the prorated amount, or none at all). The importer may also transfer the allotment to entries at another port. However, in any of these scenarios, the importer may not enter more than the total prorated amount that was properly presented at opening.
