FMC to Hold Meeting on NVOCC NRA Proposed Rule

The Federal Maritime Commission has issued a notice announcing that it will hold a public meeting to receive oral comments concerning its proposed rule on non-vessel-operating common carrier (NVOCC) Negotiated Rate Arrangements (NRAs) on May 24, 2010 in Washington, DC.

Requests to participate in the meeting are due by May 14, 2010.

FMC Proposes to Create Exemption from Requirement to Publish Rate Tariffs

FMC recently issued a proposed rule to amend 46 CFR Part 520 and create a new Part 532 to make available to licensed NVOCCs a new, voluntary exemption from the requirement to publish rate tariffs, if they agree to NRAs with their shippers.

The proposed rule would relieve licensed NVOCCs from the cost and burden of rate tariffs publication. Publication of rule tariffs would continue to be required. In addition, any NVOCC failing to maintain its bond or license, or who has had its tariff suspended by the FMC, would not be eligible to invoke an NRA exemption.

In its proposed rule, FMC noted that they would hold a public meeting if they received a request from an interested party to present oral comments to FMC by May 14th.

Comments on the proposed rule are due by June 4, 2010.
