AD: China Saccharin

The International Trade Administration has issued the preliminary results of an antidumping duty changed circumstances review of saccharin from China, and has preliminarily determined that there is insufficient evidence of changed circumstances to warrant revocation of the order.

The ITA initiated this review to determine whether the domestic industry is in fact no longer interested in this AD duty order, pursuant to PMC Specialties Group, Inc. (PMCSG)'s statement that no further interest exists in continuing the order.

ITA is Unable to Determine Domestic Industry, Intends Not to Revoke Order

The ITA states that PMCSG failed to respond to its questionnaire in this review; therefore, the ITA is unable to determine PMCSG's status as a producer of the domestic like product and whether it represents "substantially all of the production of the domestic like product," as required under the ITA's regulations governing revocation. Accordingly, the ITA intends to not revoke the AD duty order on saccharin from China.

The ITA will issue the final results of this changed circumstances review, which will include its analysis of any written comments, no later than 270 days after July 15, 2009, or within 45 days if all parties agree to its preliminary results.

If revocation occurs, the ITA will instruct U.S. Customs and Border Protection to end the suspension of liquidation for the merchandise covered by the revocation on the effective date of the notice of revocation and to release any cash deposit or bond. The current requirement for a cash deposit of estimated AD duties on all subject merchandise will continue unless and until it is modified pursuant to the final results of this changed circumstances review.
