AD: Italy Certain Pasta

The International Trade Administration has issued the final results of its antidumping duty changed circumstances review of certain pasta from Italy.

(This review was initiated to determine whether partial revocation of the AD duty order is warranted with respect to gluten-free pasta.)

Gluten-Free Pasta Excluded from AD Duty Order

The ITA has made a final determination that the petitioners have no interest in the AD duty order with respect to gluten-free pasta.

Therefore, the ITA has amended the scope of the AD duty order on certain pasta from Italy to include the following exclusion: Excluded from the scope is gluten-free pasta.

Revocation for Gluten-Free Pasta is Retroactive to July 1, 2008

Pursuant to Pasta Lensi S.r.L.'s request, the ITA has determined to retroactively revoke the subject AD duty order for gluten-free pasta to July 1, 2008, (the date following the last day of the most recently completed administrative review).

Therefore, the ITA will instruct U.S. Customs and Border Protection to liquidate, without regard to AD duties, all unliquidated entries of gluten-free pasta from Italy not currently subject to an administrative review of certain pasta from Italy with a time of entry on or after July 1, 2008.

Cash Deposits to be Refunded for Entries On or After August 14th

The ITA will further instruct CBP to refund with interest any estimated AD duties collected with respect to unliquidated entries of gluten-free pasta with a time of entry on or after August 14, 2009.
