CBP Guidance on Expiration of Mexican Cement Agreement (Import License Numbers, Export Licenses No Longer Required)

U.S. Customs and Border Protection has posted a memorandum providing guidance on the expiration of the U.S.-Mexico Agreement on Trade in Cement (Mexican Cement Agreement).

(In March 2006, the Office of the U.S. Trade Representative, the Mexican Secretaria de Economia, and the International Trade Administration entered into the Mexican Cement Agreement. The ITA has previously stated that the agreement would expire on March 31, 2009, at which time the ITA would revoke the antidumping duty order effective April 1, 2009, if all the terms of the agreement were complied with by interested parties.)

Importer License Numbers, Export Licenses No Longer Required

Pursuant to the termination of the Mexican Cement Agreement and the revocation of the AD duty order on gray portland cement and clinker from Mexico, the memo states that imports of subject merchandise with a duty computation date on or after April 1, 2009 will no longer require an import license number or an export license and will not be subject to an AD duty order.

(Under the agreement, exporters were required to obtain, prior to entry, an export license issued by the government of Mexico and importers were required to apply for an import license number issued by the Commerce Department. Both a copy of the export license and the import license number were required to be provided to CBP when the importer filed a CBP Form 7501.)

Liquidation Instructions Posted to CBP's AD/CVD Web Site

The liquidation instructions for the revocation of the AD duty order have been posted to CBP's ADD/CVD Web site and are available at http://addcvd.cbp.gov/detail.asp?docID=9096202&ac=pr.
