AD: China, Vietnam Frozen Warmwater Shrimp

According to an International Trade Administration notice initiating antidumping duty administrative reviews of frozen warmwater shrimp from Vietnam (A-552-802) and China (A-570-893), the 682 entities that are subject to these reviews for the period February 1, 2008 - January 31, 2009 are required to submit either a separate rate status certification by April 27, 2009, or a separate rate status application by May 26, 2009.

Certifications Due April 27th or Could Lose Separate Rate Status, Applications due May 26th or Could Lose Chance for Separate Rate Status

According to the ITA, entities that were assigned a separate (lower) rate in the most recent segment of this AD proceeding in which they participated must submit a Separate Rate Certification no later than April 27, 2009, or effective at the final results of this administrative review, could lose their separate rate status and instead receive the China-wide entity rate (currently 112.81%) or the Vietnam-wide entity rate (currently 25.76%).

Entities that have not previously been assigned a separate rate (and are therefore subject to the China-wide or Vietnam-wide entity rate) must submit a Separate Rate Application no later than May 26, 2009, or they could lose their chance to obtain a separate (lower) rate, effective at the final results of these administrative reviews.

Comments on CBP Data, Respondent Selection Due April 6th

For these administrative reviews, the ITA intends to select respondents based on U.S. Customs and Border Protection (CBP) data for U.S. imports during the review period. The ITA invites comments regarding the CBP data and the selection of respondents by April 6, 2009.

Notices of No Sales During the Review Period Due April 27th

If a producer or exporter named in the ITA's notice of initiation had no exports, sales or entries during the review period, it must notify the ITA by April 27, 2009. (See initiation notice for complete instructions on the submissions of notices of no sales.)

Requests for Revocation in Part for Certain Companies

The ITA also received a timely request to revoke, in part, the AD duty order on shrimp from China for Zhanjiang Regal Integrated Marine Resources Co., Ltd.

In addition, the ITA received timely requests to revoke, in part, the AD duty order on shrimp from Vietnam for multiple producer/exporters (see notice for company names).

(The final results of these administrative reviews are due by March 9, 2010.)
