The ITA initiated this changed circumstances review to consider partially revoking the order to exclude ultra low pulp (ULP) orange juice pursuant to request from Tropicana Products, Inc.

Intent Not to Exclude ULP Orange Juice, Over 15% of Industry Opposition

The ITA states that under the definition of "substantially all," over 15% of the domestic industry has expressed opposition to excluding ULP orange juice from the AD duty order on certain orange juice from Brazil.

As a result, the ITA preliminarily determines that changed circumstances sufficient to warrant revocation in part of the AD duty order do not exist, and therefore the ITA intends not to exclude ULP orange juice from the scope of the order.

The current requirements for the cash deposit of estimated AD duties on the subject merchandise will remain in effect until further notice.

(See ITA notice for more information, including the scope of the order, etc.
