CBP Instructions for Revocation of CV Duty Orders for Korea DRAMs, Third Country Importers

U.S. Customs and Border Protection has issued multiple ADD/CVD messages regarding the revocation of the countervailing duty orders on dynamic random access memory semiconductors (DRAMS) from Korea and certain third country importers.

(In 2003, CBP issued instructions on the International Trade Administration's final affirmative CV duty determination on DRAMS from Korea, which included all assembled DRAMS from third countries which contain unassembled Korean DRAMS and all memory modules from third countries which contain Korean DRAMS (assembled or unassembled), and assigned those third countries their own case numbers.

CV Duty Orders Revoked for Korea DRAMs, 24 "Third" Countries

The ITA previously revoked the CV duty order on DRAMS from Korea effective August 11, 2008, and CBP notes that notice of the lifting of suspension of liquidation occurred with the ITA's publication of the notice of revocation in the Federal Register. The CV duty orders are also revoked for the following 24 "third" countries:

Liquidation, Cash Deposits/Bonds on/after August 11, 2008 to be Refunded

For all subject CV duty orders, CBP is directed to terminate the suspension of liquidation for all shipments of DRAMS with a time of entry on or after August 11, 2008. All entries of the subject product that were suspended on or after August 11, 2008 should be liquidated without regard to CV duties (i.e., release all bonds and refund all cash deposits).

Entries of the subject product with a time of entry prior to August 11, 2008 should not be liquidated until separate and specific liquidation instructions are issued.
