Census Issues Memo on Proof of Filing Citations for Approved Postdeparture Filers

The Census Bureau has issued a memorandum regarding proof of filing citations for approved postdeparture filers.

Census' memorandum instructs U.S. Principal Parties in Interest (USPPIs) and authorized agents to adhere to the requirements in the Foreign Trade Regulations (FTR) for properly annotating export documents for Electronic Export Information (EEI) filed through AES.

(As specified in 15 CFR 30.7, the USPPI or the authorized agent must properly annotate the bill of lading, air waybill, or other commercial loading documents with the proof of filing citation. Census notes that Appendix D to 15 CFR Part 30 also provides examples of filing citations.)

Examples of Correct AES Postdeparture Filing Citations

According to Census, the following are examples of correct AES Postdeparture Filing citations for postdeparture shipments:

AES Postdeparture Citation - if the USPPI is filing the EEI

AESPOST USPPI EIN mm/dd/yyyy (Date of Export)

Example: AESPOST 123456789 10/01/2008

AES Postdeparture Citation - if the Authorized Agent is filing the EEI

AESPOST USPPI EIN- Filer ID mm/dd/yyyy (Date of Export)

Example: 123456789 - 987654321 10/01/2008

Failure to Comply Could Result in Revocation of Postdeparture Filing Privileges, Penalties

Census notes that every effort must be made by the USPPI or authorized agent to comply with these requirements.

Failure to comply could result in immediate revocation of the Postdeparture filing privileges and/or penalties.

According to 15 CFR 30.4(c), postdeparture filing is only available for approved USPPIs and provides for the electronic filing of the required data elements no later than ten calendar days from the date of exportation. For USPPIs approved for postdeparture filing, all shipments (other than those for which predeparture filing is specifically required), by all methods of transportation, may be exported with the filing of electronic export information made postdeparture. Certified AES authorized agents or service centers may transmit information postdeparture on behalf of USPPIs approved for postdeparture filing, or the approved USPPI may transmit the data postdeparture itself. However, authorized agents or service centers will not be approved for postdeparture filing.

The moratorium placed on Census' acceptance of new letters of intent (LOI) to participate in postdeparture filing in August 2003 remains in effect pending further review of the program. As a result, postdeparture filing is limited to currently approved participants.)
