PHMSA Proposes to Increase Registration Fees for Certain Hazmat Transporters and Offerors, Etc.

The Department of Transportation's Pipeline and Hazardous Materials Safety Administration has issued a proposed rule which would modify 49 CFR Part 107 by, among other things, increasing the registration fees for 2009-2010 and following years paid by persons who transport or offer for transport certain categories and quantities of hazardous materials (hazmats), for those registrants not qualifying as a small business or not-for-profit organization.

According to the PHSMA, the increase is necessary to fund the national Hazardous Materials Emergency Preparedness (HMEP) grants program at approximately $28 million, in accordance with the Administration's fiscal year 2008 budget.

Proposal to More than Double Hazmat Registration Fees for Larger, For-Profits

For those registrants not qualifying as a small business or not-for-profit organization, PHMSA is proposing to increase the fee from $975 (plus $25 administrative fee) to $2,475 (plus $25 administrative fee) for registration year 2009-2010 and following years.

(In 2006, PHSMA proposed increasing the $975 fee to $1,975 for registration year 2007-2008 and $2,975 for registration year 2008-2009 and following years, but the fee increase was never finalized. (See ITT's Online Archives or 08/23/08 news, 06082320, for BP summary.)
